Acceptable Use Policy

This “Acceptable Use Policy” or “AUP” sets forth the terms and conditions for acceptable use of the Services. Capitalized terms used herein but not defined will have the meaning assigned to them in the governing agreement between Amadeus and Customer (“Agreement”). If there is any inconsistency between this Acceptable Use Policy and the Agreement, the Agreement will control.

Customer acknowledges and agrees (on behalf of itself, all Customer Licensees, Users and any third parties permitted to provide services on Customer’s behalf under the Agreement):

  1. to use the Services only in accordance with the Documentation and the applicable Service Order;
  2. not to upload, permit or enable in any way any information or content that contain any viruses, worms, time bombs, Trojan horses and other intentionally harmful or malicious code, files, scripts, agents, or programs or data that may damage the operation of the Subscription Services or another’s computer or mobile device;
  3. not to use, permit or enable any Subscription Service for illegal, fraudulent, unethical or inappropriate purposes;
  4. not to interfere or disrupt networks connected to any Subscription Service or interfere with others’ ability to access or use any Subscription Service or permit or enable any third party to do so;
  5. not to distribute, promote or transmit through the Subscription Service any unlawful, harmful, obscene, pornographic or otherwise objectionable material of any kind or nature or permit or enable any third party to do so;
  6. not to transmit or post any material that encourages conduct that could constitute a criminal offense or give rise to civil liability or permit or enable any third party to do so;
  7. not to upload into any Subscription Service any information not explicitly required by the Subscription Service, including financial data or sensitive Personal Data (as defined in GDPR or other applicable Law) or permit or enable any third party to do so;
  8. not to interfere with another customer’s use and enjoyment of the Subscription Service Service or another person or entity’s use and enjoyment of similar services or permit or enable any third party to do so;
  9. not to use the Subscription Service in any manner that impairs the Subscription Service, including the servers and networks on which the Subscription Service is provided or permit or enable any third party to do so;
  10. not permit or enable any third-party to access the Subscription Services. Administrators may assign only an individual User to each account (i.e., no shared accounts), and each User account must be associated with a Customer Licensee-branded or Customer Property Manager-branded email address (e.g., not a gmail or hotmail or an account associated with a third-party entity). For clarity, personnel of third-party vendors of Customer Licensees are not permitted to be Users.
  11. to comply with all regulations, policies and procedures of networks connected to the Subscription Service and Amadeus’s service providers;
  12. to at all times use commercially reasonable efforts to optimize its usage of the Subscription Service’s capacity and shall implement Amadeus’ reasonable recommendations in relation to such optimization in a timely manner; and
  13. to comply with any acceptable use policies and other terms of any third-party service provider that are provided or otherwise made available to Customer from time to time that Amadeus is required to flow down to Customer.

Amadeus reserves the right to amend, alter, or modify the AUP at any time. Amadeus may deliver notice of such updated AUP to Customer via e-mail,  the Subscription Services or as otherwise set forth in the Agreement. Customer’s continued access to and use of the Subscription Services following issuance of such updated AUP shall constitute Customer’s acceptance thereof.
